The Northern Territory Supreme Court has ruled that a midnight pegging expedition from a group of men at uranium deposit sites near Alice Springs was unlawful.

Mining entrepreneur Norm McCleary lead the group, who at midnight on December 7 pegged out a section of land at the Angela and Pamela deposit sites worth tens of millions of dollars.

The Supreme Court has found that the group was trespassing when it drove pegs into the land.

But Justice Trevor Riley ruled that Territory's Mining Department should consider the plaintiff's application for another area of land.
